1. Definitions

• "Services" refers to Peachy Budget, Peachy Tasks, and any other applications or services provided by Peachy Group
• "Account" means your registered user account
• "Content" means any data, text, information, or materials you create or upload to our Services
• "Subscription" means a paid plan that provides access to our Services
• "We," "our," or "us" refers to Peachy Group
• "You" or "User" refers to the individual or entity using our Services

2. Service Description

2.1 Peachy Budget

A financial management application that allows you to track transactions, manage budgets, visualize spending patterns, and project future balances. Available on web, iOS, and Android platforms.

2.2 Peachy Tasks

A task management application with project organization, Kanban boards, tags, and multi-platform sync. Available on web, iOS, and Android platforms.

2.3 Service Availability

We strive to provide reliable service but do not guarantee uninterrupted access. Services may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

3. Account Registration and Security

3.1 Account Creation

To use our Services, you must:

• Be at least 13 years of age
• Provide a valid email address
• Create a secure password
• Agree to these Terms of Service and our Privacy Policy

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Using a strong, unique password

3.3 Account Accuracy

You agree to provide accurate, current, and complete information and to update it as necessary to maintain its accuracy.

4. Subscription and Payment Terms

4.1 Free Trial

• Duration: 7 days from account creation
• Access: Full access to all features
• No Credit Card Required: You can try our services without payment information
• Trial Limitations: One trial per email address; trial access cannot be extended

4.2 Pricing Plans

Current pricing (subject to change with 30 days notice):

• Individual App: $6.00 CAD per month per application
• Bundle (Both Apps): $10.00 CAD per month
• Annual Bundle: $108.00 CAD per year ($9.00/month billed annually)

4.3 Payment Processing

• Payments are processed securely through Stripe
• All prices are in Canadian Dollars (CAD)
• Applicable taxes (GST/HST/PST) will be added based on your province
• Payment methods accepted: Credit cards, debit cards (via Stripe)

4.4 Billing Cycle

• Subscriptions renew automatically each month or year
• You will be billed on the same day each billing period
• Renewal charges appear 1-2 business days before renewal date
• We will send email reminders before each renewal

4.5 Cancellation Policy

You may cancel your subscription at any time:

• Cancel through your Account Settings
• Cancellation takes effect at the end of your current billing period
• You retain access until the end of the paid period
• No Refunds: We do not provide refunds for partial months or unused time, except as required by Canadian consumer protection law

4.6 Price Changes

• We reserve the right to change pricing with 30 days advance notice
• Existing subscribers will be notified via email
• Continued use after price changes constitutes acceptance of new pricing
• You may cancel before the price change takes effect

5. Acceptable Use Policy

5.1 Permitted Use

You may use our Services for lawful personal or business purposes in accordance with these Terms.

5.2 Prohibited Activities

You agree NOT to:

• Violate any Canadian federal, provincial, or local laws
• Share your account credentials with others
• Attempt to gain unauthorized access to our systems or other users' accounts
• Use our Services to store or transmit malicious code, viruses, or malware
• Reverse engineer, decompile, or disassemble our software
• Use automated scripts or bots to access the Services
• Resell or redistribute our Services without authorization
• Remove or alter any copyright, trademark, or proprietary notices
• Use the Services to harass, abuse, or harm others
• Upload illegal, obscene, or offensive content

6. Your Content and Data

6.1 Ownership

You retain all ownership rights to the Content you create or upload to our Services. We do not claim ownership of your financial data, tasks, or other information.

6.2 License to Us

By using our Services, you grant us a limited license to:

• Store and display your Content to provide the Services
• Back up your Content for data protection purposes
• Use anonymized, aggregated data for service improvement (no personal data)

6.3 Data Export

You can export your data at any time in CSV or JSON format through Account Settings.

6.4 Data Backup

While we perform regular backups, you are responsible for maintaining your own backups of important data. We are not liable for data loss.

7. Intellectual Property Rights

7.1 Our Property

All intellectual property in the Services, including software, design, logos, text, and graphics, is owned by Peachy Group or our licensors and is protected by Canadian and international copyright, trademark, and other intellectual property laws.

7.2 Trademarks

"Peachy Group," "Peachy Budget," "Peachy Tasks," and related logos are trademarks of Peachy Group. You may not use these marks without our prior written permission.

7.3 Feedback

If you provide suggestions, feedback, or ideas about our Services, we may use them without obligation or compensation to you.

8. Limitation of Liability

8.1 Disclaimer of Warranties

Our Services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:

• Warranties of merchantability or fitness for a particular purpose
• Accuracy, reliability, or completeness of information
• Uninterrupted or error-free operation
• Security of data transmission or storage

8.2 Financial Information Disclaimer

Peachy Budget is a tracking tool, not financial advice. We do not provide financial, investment, tax, or legal advice. Consult a qualified professional for financial decisions. You are solely responsible for the accuracy of your financial data and budget decisions.

8.3 Limitation of Damages

To the maximum extent permitted by Canadian law:

• We are not liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim
• This includes but is not limited to damages for lost profits, data loss, business interruption, or financial losses

8.4 Consumer Protection Rights

Nothing in these Terms limits your rights under Canadian consumer protection legislation, including any provincial consumer protection acts.

9. Indemnification

You agree to indemnify, defend, and hold harmless Peachy Group and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the Services
• Your violation of these Terms
• Your violation of any rights of another party
• Your Content or data uploaded to the Services

10. Termination

10.1 Termination by You

You may terminate your account at any time by:

• Canceling your subscription through Account Settings
• Requesting account deletion via email to contact@peachygroup.ca

10.2 Termination by Us

We may suspend or terminate your account immediately if:

• You violate these Terms of Service
• Your payment fails and is not resolved within 7 days
• We suspect fraudulent or illegal activity
• Required by law or government authority

10.3 Effect of Termination

• You will lose access to the Services immediately upon termination
• You have 30 days to export your data before deletion
• Subscription fees are non-refundable upon termination
• Certain provisions (intellectual property, liability limitations) survive termination

11. Privacy and Data Protection

Your use of our Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information in compliance with PIPEDA and Canadian privacy laws.

12. Dispute Resolution and Governing Law

12.1 Governing Law

These Terms are governed by the laws of Canada and the province in which Peachy Group is registered, without regard to conflict of law principles.

12.2 Jurisdiction

Any disputes arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of Canada and the applicable province.

12.3 Informal Resolution

Before filing any legal claim, you agree to contact us at contact@peachygroup.ca to attempt to resolve the dispute informally.

12.4 Class Action Waiver

To the extent permitted by law, you agree to resolve disputes on an individual basis and waive the right to participate in class action lawsuits.

13. Modifications to Terms

13.1 Right to Modify

We reserve the right to modify these Terms at any time. We will provide notice of material changes by:

• Posting the updated Terms with a new "Last Updated" date
• Sending email notification to your registered email address
• Displaying a prominent notice in the application

13.2 Acceptance of Changes

Continued use of the Services after changes become effective constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Services and cancel your subscription.

14. Third-Party Services

Our Services integrate with third-party providers:

• Stripe: Payment processing (subject to Stripe's terms)
• Render.com: Hosting infrastructure

We are not responsible for third-party services or their terms. Your use of third-party services is at your own risk.

15. Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, government actions, internet outages, or power failures.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Peachy Group regarding the Services and supersede all prior agreements and understandings.

18. No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

19. Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms without restriction.
